Effective September 1, 2017, New York will exempt cemetery monuments from sales and use tax.

New York taxes sales of tangible personal property unless an exemption applies. Beginning September 1, 2017, New York will exempt monuments.

For this exemption, a monument is a "memorial erected in a cemetery on a lot, plot, or part thereof, except private mausoleums." The exemption will not apply to private mausoleums but will apply to public mausoleums, which are included in the definition of "cemetery."

Although the monuments themselves will be exempt, the services of cleaning, repairing, or maintaining monuments will remain subject to sales tax.
