The South Carolina Administrative Law Court recently ruled that bookstore memberships are taxable.

The taxpayer operates a discount book retail business and offers a membership program to its customers. Customers must pay an annual fee to belong to the membership program. The membership program allows customers to purchase various books and other items at a discounted price.

South Carolina measures the tax owed based on a taxpayer's gross proceeds of sales. This includes the value of services and intangibles that are a direct result of the sale of tangible personal property. The court concluded that the membership fees were taxable as part of the gross proceeds because they were a direct result of the bookstore's discounted sales of tangible personal property.
