Exempt Entities

Missouri ruled that parts used to repair aircraft were exempt.

A taxpayer maintained and repaired aircraft for its customers. To do this, the taxpayer bought parts and equipment used to repair or modify the aircraft.

Missouri exempts materials, parts, and equipment used directly for the modification, replacement, repair, and maintenance of aircraft. Missouri also exempts aircraft parts purchased for use by common carriers.

The items the taxpayer bought were used directly to modify, replace, repair, or maintain aircraft. As a result, the sales were exempt. The taxpayer did not also have to qualify for the common carrier exemption.
