New York has released guidance regarding the taxability of subscription services that compile information and provide it to clients. The taxability of these services depends on who the information is available to.

When the information is available to the general public, the service is taxable. However, when the information is "personal or individual in nature," the service is not taxable. The Department of Revenue and Finance stated that "personal or individual" information comes from sources that are not common or generally available to the public.

Because taxability depends on the source of the information, information services can be either taxable or nontaxable.
