Additional Fees on a Rental of Real Property are Taxable in Florida

The Florida Department of Revenue (DOR) issued guidance explaining that additional fees for renting real property were taxable as part of the total rental charges.

A hospital rented a property from an owner that was exempt from property tax. This resulted in a lower rent for the property. Some of the hospital's competitors complained that this gave the hospital an unfair advantage, so the hospital agreed to pay additional fees as well as the regular rental charges.

The DOR determined that the additional fees were included in the taxable rental charges. As a result, tax was due on these fees.
