Latex Mattresses are Not Exempt as Durable Medical Equipment in Virginia

The Virginia Tax Commissioner published a letter ruling determining that natural latex mattresses were not exempt durable medical equipment.

A furniture company selling natural latex mattresses required customers to provide a prescription from a doctor or chiropractor in order to purchase the mattresses. No tax was charged on these purchases.

The Tax Commissioner concluded that the mattresses were taxable because they did not qualify as durable medical equipment. To qualify as durable medical equipment, the mattress must generally not be useful in the absence of illness or injury. These mattresses were determined to be useful to people who are not sick or injured.
