Alabama Tax Delinquency Amnesty Act of 2016

Alabama recently enacted the Alabama Tax Delinquency Amnesty Act of 2016. For at least two months during 2016, Alabama will grant amnesty for taxes due before, or for tax periods that began before, January 1, 2015. Taxpayers who want to take advantage of the program have to apply for amnesty and pay all tax due for those periods. If the application is approved, half of the interest and all of the penalties accrued for those taxes will be waived. The amnesty program will occur before August 31, 2016.

Amnesty will not apply to motor fuel taxes, penalties for failure to collect and pay over tax, penalties for attempting to evade taxes, and penalties for failure to submit information reports not based on underpayment of tax. Amnesty is not available to taxpayers who (1) have been contacted by the Department of Revenue or (2) are parties to a criminal investigation or litigation for nonpayment, delinquency, or fraud in relation to state taxes.
