Colorado Exempts Dyed Diesel Fuel

Colorado has amended its exemption statute for fuel and fuel oil. Effective March 26, 2015, this exemption extends to all sales of dyed diesel fuel. Prior to this new exemption, most sales of dyed diesel were already exempt. However, the new exemption eliminates tax on the few sales that were taxable.

Dyed diesel is diesel fuel that is dyed under the rules of the United States Environmental Protection Agency or the Internal Revenue Service for high sulphur diesel fuel or low sulphur diesel fuel or under any other requirements subsequently set by such agencies for special fuel sold for nontaxable uses.
