Florida Exempts Therapeutic Veterinary Diets

The Florida Department of Revenue released guidance on the taxability of animal food.

Florida taxes sales of animal food unless an exemption applies. Effective July 1, 2014, therapeutic veterinary diets became exempt. "Therapeutic veterinary diets" are animal foods that are (1) specifically formulated to aid in the management of illness and disease, (2) sold for animals diagnosed with a health disorder, and (3) only available from a licensed veterinarian. If the food treats an illness or disease but can be purchased from retailers, the food is not exempt.

Florida also exempts three more types of animal food. First, animal foods that must be dispensed under a prescription by law are exempt. Such drugs must carry the label "Caution: Federal law restricts this drug to sale by or on the order of a licensed veterinarian." Second, feed for poultry, ostriches, livestock, racehorses, and dairy cows is exempt. Finally, food for guide dogs is exempt.
