Kansas Revenue Ruling Discussing Pet Adoption Fees Revoked

The Kansas Department of Revenue recently issued a notice revoking Revenue Ruling 19-2012-01, (originally reported on here) which discussed the taxability of certain fees associated with pet adoptions. Kan. Public Notice No. 12-15 (Dept. of Revenue Jul. 19, 2012).

The revoked ruling stated that animal adoption fees charged by animal shelters were subject to retailers' sales tax.The sale of a pet is subject to tax because it is considered tangible personal property. However, fees charged by non-profit animal shelters that are meant to cover costs associated with preparing the animal for adoption, such as vaccinations, deworming, spaying or neutering, and health examinations, will not be considered as part of the purchase price of the animal and such fees will not be subject to tax.
