West Virginia Repeals Telecommunications Tax

West Virginia recently enacted legislation repealing its Telecommunications Tax. See the governor's announcement here. See the enrolled bill (House Bill 4088) here.

West Virginia's Telecommunications Tax applied to businesses engaged in furnishing telecommunications services. It was imposed at a rate of 4% on the gross income attributable to services not subject to competition. House Bill 4088 fully repeals the tax effective March 7, 2012.

The tax was initially enacted in 1988, but since that time the telecommunications industry has changed drastically, so now there are fewer telecommunications services that are not subject to competition. Thus, for many telecommunications providers the repeal of the Telecommunications Tax will have minimal impact.
