Texas Releases Detailed Guidance on Exempt Organizations

The Texas Comptroller has released a publication that provides detailed information on how sales and use tax applies to exempt organizations. The publication explains that certain nonprofit and government organizations are exempt from paying sales and use tax.

The exemption from sales and use tax for governmental entities applies to federal, state, and local government. The exemption for nonprofit organizations applies to religious, charitable, and educational organizations. Nonprofit organizations discussed in the publication include 501(c)(3) organizations, youth athletic organizations, volunteer fire departments, and tourism promotion agencies.

The publication provides a chart that shows how sales tax, hotel tax, and motor vehicle tax apply to various types of entities. In addition, the publication addresses taxable and exempt sales by exempt organizations, and explains how to claim exemptions.
