The Arkansas Department of Finance and Administration recently addressed the taxability of various products and services provided by a self-described "motion designer." The services provided by the taxpayer included animation, motion graphics, video editing, post-production, photography, graphic design, and other digital post-production work.

Arkansas taxes photography services, sales of specified digital products (electronically transferred videos, audio, and books), and subscriptions to videos with sound (digital audio-visual works) and audio works.

The ruling determined that the taxpayer's animation and motion graphics did not contain audio, and were therefore not taxable as videos with sound. However, digital audio files sold by the taxpayer were found to be taxable unless resold by the purchaser. The ruling also found that graphic design services are not taxable, and that the taxpayer may be entering into bundled transactions, which could cause otherwise nontaxable products and services to be taxable if not separately stated.,_Design,_and_Photography_Service_in_Arkansas
