Digitally Downloaded Embroidery Patterns Not Taxable in Arkansas

The Arkansas Department of Finance and Administration (DFA) recently ruled that sales of digitally downloaded files containing embroidery patterns are not taxable.

The shop owner sells downloadable stitch files that are read by sewing machines to create embroidered patterns. Customers purchase the files, load the files into their sewing machines, and then stitch the design on whatever product they choose.

Arkansas taxes sales of specified digital products. Specified digital products include digital audio works, digital audio-visual works, and digital books. The DFA ruled that these embroidery files did not qualify as specified digital products because they are not sounds, a series of images, or books.
