Colorado Waives Penalties for Notice and Reporting Requirements

The Colorado Department of Revenue (DOR) released a publication stating that it has agreed to waive penalties for failing to comply with the state's notice and reporting requirements for sales made before July 1, 2017.

In 2010, Colorado passed a law that created notice and reporting requirements for retailers who make sales to into Colorado but do not collect Colorado use tax. However, for seven years, state and federal injunctions prevented the DOR from implementing that law.

After the settlement of a case in February 2017 removed those injunctions, the DOR began enforcing the requirements on July 1, 2017. The DOR has announced that it will waive any penalties associated with the failure to follow the notice and reporting requirements for sales made before July 1, 2017.
