Louisiana Notice Requirements for Remote Sellers

The Louisiana Department of Revenue released an information bulletin reminding taxpayers about notice requirements for certain remote sellers.

Remote sellers whose sales to Louisiana customers exceed $50,000 per year must notify their customers that online purchases of tangible personal property and taxable services are subject to Louisiana use tax. The first notification must be sent by January 31, 2018, and subsequent notifications must be sent by January 31 each year.

The notice must provide (1) the total amount paid by the purchaser, (2) dates and amounts of purchases, (3) whether the property or service is exempt from sales and use tax, (4) the name of the retailers, and (5) a statement that purchaser may be required to pay Louisiana use tax on purchases made from the retailer.
