Retailers Cannot Advertise Tax-Free Sales in Nebraska

The Nebraska Department of Revenue recently released guidance explaining that retailers cannot advertise or imply that they will pay, assume, or absorb tax for their customers. Under Nebraska law, retailers are required to pass the full amount of sales tax to their customers as a separate line item on invoices or other sales receipts.

Examples of prohibited language that cannot appear in advertisements includes (1) tax-free sale, (2) pay no sales tax, (3) purchases will be discounted by the amount of sales tax, (4) sales tax stimulus sale, (5) receive a discount equal to the sales tax, (6) we will pay your sales tax, and (7) tax credit sale.
