Nevada Announces 2021 Tax Amnesty Program

The Nevada state legislature has approved a one-time tax amnesty program for businesses and individuals doing business in the state. The amnesty period will begin February 1, 2021, and end on May 1, 2021. The program allows penalty and interest to be waived on outstanding liability if the following requirements are met:

  1. The outstanding tax was due and payable on or before June 30, 2020. This includes liabilities from all monthly tax returns due on or before June 30, 2020, and all quarterly tax returns due on or before April 30, 2020.
  2. The outstanding tax is paid in full for the period. If a taxpayer has several late returns but is only able to pay one or more periods, the penalty and interest may be waived for each period the tax is paid in full; and
  3. The outstanding tax is paid during the amnesty period.

This program is available for a variety of tax types, including sales and use tax. The amnesty program does not apply to businesses or individuals that have entered into a compromise or settlement agreement with the Department of Taxation or Nevada Tax Commission regarding the unpaid tax or assessment. Taxpayers are also ineligible if they are currently under audit and do not receive a final deficiency determination before the last day of the amnesty period.
